The National Prosecuting Authority (NPA) has welcomed the sentencing of 47-year-old Neil Klein by the Pretoria North Magistrates’ Court for rape and attempted rape. Klein, originally from Cape Town, was sentenced to 20 years of direct imprisonment.
The court handed down a 15-year prison sentence for the rape of a 32-year-old man and an additional five years for the attempted rape of a 43-year-old man. Klein was also declared unfit to possess a firearm.
At the time of the incidents, Klein and the two victims were living at a shelter in Akasia. The first incident occurred on 9 July 2023 when the 43-year-old victim went to the shelter’s bathroom and encountered Klein. Klein allegedly threatened the victim, locked the bathroom door and undressed himself. The incident was interrupted when someone knocked on the door.
Four months later, on 5 November 2023, a second incident took place involving a 32-year-old victim who also went to the bathroom and encountered Klein. Klein allegedly threatened the victim, ordered him to undress and raped him. After the assault, Klein left the victim in the bathroom.
The victim immediately reported the incident to a woman who worked as a cook at the shelter. After hearing about the report, the 43-year-old victim also revealed the earlier incident. The matter was reported to the police the same day, and Klein was arrested at the shelter the following day.
During the trial, Klein pleaded not guilty, claiming that the 43-year-old victim had falsely accused him due to an alleged debt. However, State Prosecutor Advocate Given Twala presented evidence and testimony from both victims, which proved Klein’s guilt beyond a reasonable doubt.
During sentencing proceedings, Klein’s legal representative asked the court to impose a lesser sentence, citing his difficult upbringing, limited education due to epilepsy, and the fact that he had previously lived on the streets of Pretoria Central before moving to the shelter.
However, the State opposed the request, arguing that Klein had committed serious crimes and had shown no remorse. Advocate Twala also pointed out that Klein had previous convictions for attempted rape and indecent assault, which had not deterred him from committing further offences. The court also heard that Klein targeted vulnerable men who were trying to rebuild their lives while staying at the shelter.
The State further argued that there were no substantial and compelling circumstances that would justify deviating from the prescribed minimum sentence.
In delivering judgment, the magistrate agreed with the State, noting that Klein deliberately targeted vulnerable individuals and showed no remorse for his actions. The court also acknowledged that male victims often face difficulties when reporting sexual offences, which may explain why the 43-year-old victim initially did not report the incident.
The magistrate emphasised the importance of imposing appropriate sentences to ensure justice is served and to discourage communities from resorting to vigilantism. The court therefore found no valid reasons to deviate from the prescribed minimum sentence and imposed 15 years’ imprisonment for rape and five years for attempted rape.
The NPA reaffirmed its commitment to prosecuting sexual offences and protecting vulnerable individuals while ensuring that perpetrators are held accountable.
