Bongani Gumede Takes Pick n Pay to Court Over R1 Million Accident Claim

Prominent South African actor Bongani Gumede has initiated a high-profile civil claim against retail giant Pick n Pay, seeking damages of R1 million after an alleged accident at one of their stores left him with significant injuries and impacted his career.

The incident is said to have occurred earlier this year at the Pick’n Pay branch in Steeledale, Johannesburg. According to papers filed at the Johannesburg High Court, Gumede, known for his roles in local television and theatre, was shopping when he allegedly tripped and fell over a shopping trolley that was left in an aisle with no visible warning or marking.

The court documents detail that the fall resulted in “severe and lasting injuries” to Gumede’s right knee and shoulder. His legal representatives argue that the injuries have had a direct and detrimental effect on his professional capacity as a performer. “Mr. Gumede’s livelihood depends on his physical ability to perform, a capacity that has been severely compromised,” the papers state. The R1 million claim encompasses medical expenses, future rehabilitation costs, loss of income, and general damages for pain and suffering.

A spokesperson for Gumede emphasized the broader principle at stake. “This case is not merely about compensation; it’s about corporate accountability and the fundamental duty of care that large retailers owe to the public. Stores must be kept in a safe condition to prevent avoidable harm to customers.”

In response to media enquiries, Pick n Pay released a brief statement acknowledging the legal action. “Pick n Pay is aware of the claim brought by Mr. Gumede. The safety of our customers and staff is our utmost priority. As this is now an active legal matter, it would be inappropriate to comment further at this time. We are reviewing the details of the claim and will follow the process through the appropriate legal channels.”

Legal experts suggest the case will hinge on proving negligence on the part of the retailer. The plaintiff’s legal team will need to demonstrate that Pick n Pay failed in its duty to maintain a safe environment—specifically, that the trolley constituted an unusual danger of which the store was, or should have been, aware, and that they did not take reasonable steps to remove the hazard or warn customers.

The case has sparked conversation on consumer safety in public spaces, with many following the proceedings closely due to Gumede’s public profile. The actor, who has chosen to speak through his legal team, is described as being committed to a full recovery but frustrated by the physical limitations and career interruption caused by the accident.
