The Supreme Court of Appeal (SCA) has reserved judgment in a high-stakes legal battle that could determine the fate of millions of South Africa’s most vulnerable citizens, after hearing the government’s challenge to a landmark High Court ruling that found key provisions of the Social Relief of Distress (SRD) grant system had been designed in a manner that unlawfully excluded vast numbers of eligible applicants. The appeal, which was argued before a full bench in Bloemfontein on Tuesday, has drawn intense public and legal scrutiny given the SRD grant’s critical role as a lifeline for the unemployed and impoverished.
The original High Court judgment, delivered earlier this year, had declared certain aspects of the SRD grant framework unconstitutional and invalid, specifically citing the use of the so-called “income threshold” and the banking data verification system, which had inadvertently disqualified many qualifying applicants based on flawed or outdated information. The court had ordered the Department of Social Development and the South African Social Security Agency (SASSA) to urgently review and remedy the exclusions.
